Bright colours and a 'flame' look don't equate ripping off, and in this case, barely constitute 'influence'. The two GIFs previously posted look nothing like each other. By your definition of 'influence' or 'ripping off', nearly ever designer on this site is 'ripping off' each other simply by using Adobe Illustrator or Macromedia Freehand...
