so I have a resize droplet I built that opens the image, resizes to a certain width and then closes.
Does anyone know how to check if it's a landscape/portrait and resize based on the two dimensions?

Conditional Actions.
I've not used it myself, but it sounds like what you're looking for.

You can double-click the Resize part of the Action in the Pallette and in the dialog that comes up you select 'Fit image by' width or height (works in Image Ready, not sure about Photoshop).
