so i did a big job for a client and they took forever to pay me.
i agreed to do another job for them only on the condition that they sign a late-payment agreement.
it's for 10% of the total amount(~3500) accrued per day.
after 14 days it's up to $30,000, after like 40 days it's at like 2.5 million.
i have the agreement, signed and all. tomorrow is the last day they can pay me, interest starts accruing on Saturday.
anyone have any idea about this, how well it'll hold up?

usually
10% per day would be too much and will be thrown out of court
most of cases like credit cards, its 15-28% per annium.
and most places even after they sign it, will not honor it.
i say, tell them to give u half up front.

who drafted your contract?
- ********0
i drafted it.
is there a place to get standard contracts that def WILL hold up in court?
- jaymac440

you don't even have to bother with it. put a .dll timebomb which shuts down their site after one month. tick tock tick tock. ohhh sorry your site is down? pay me and I'll tell you how to fix that.
hahhahha learned that little trick from a Russian

10% per day?
They're really foolsh to have signed that in the first place.
Doubt you can enforce that either.

what dinky said.
but if you've had problems getting paid with them before, why wouldn't you ask for the $$$'s upfront?

EVERYONE PLEASE......get paid in stages......it ensures that you do a little work and get paid for it and don't do any more work for that client until you get paid for the work already done and if they don't pay you then you only spent a fraction of the time on the project and not several hours and/or months.
Personally, I write into my contracts that I get paid 50% upon client receipt of 1st round comps and then the other 50% upon completion of the project.

this was a last minute weekend job - the guy who signed it is head of the digital department and said he'll back me up as far as agreeing that it was signed.

it's already up to the finance director, i'll keep you all posted.
my wife's father is the VP of Legal at a big big company here in the city, time to give that man a call.

(Dec 8 05, 09:05)I think it was $3500.....but DAMN, thats awesome for a quicky weekend project......did you have to suck cock for that?
- ********0
it's 3,500. no cock sucking.
with the 10% sliding interest rate it goes up to about $30,000 in 14 days.

legal action means you have to be over 18 right?

(Dec 8 05, 09:08)that's about standard for a last minute job in the city that's on the weekend - not just production but the whole shebang.

I'm doing a quick rededsign of someone's site - should be a 2 week project or something on the side (not 2 weeks, 8 hours per day, 5 days a week) for $400. Like Designaked, when prices were discussed, I said I don't start work until 1/2 of the money is paid upfront through paypal. Once I see the $ in the account, I start work. Upon completion, I show him screenshots/etc of it to make sure he likes it - he sends the 2nd half of the $. Once again, soon as I see the $ in the account, I upload.
Simple as that.
