But in this case it can also be argued that the kid who lost his head was the one at fault (he was drunk, reckless, and stuck his body outside of a moving car). They were friends and did something stupid while drunk. According to what I understand, it was unintentional to say the least. We don't even know if it was the drunk driving that killed him... again the cause of fatality was the kid sticking his body our of a car.
