FAIR USE if content is used as commentary and or criticism.
Expanding the layout and including a very recognizable text-based commentary or criticism overlay should clearly indicate legitimate usage.

So one of my clients account got suspended. We are filing a counter claim. She got 3 notices from Vimeo within the last 6 months and did nothing with them. Now she's blaming me because "I didn't tell her" that she should forward me those emails so I can file counter claims. Like Im a fucking mind reader. Fucking clients...

if your just using vimeo for hosting and posting it on your site, just list the video as private and embed permissions only for that url, hide vimeo logo that links back to original url on embed permissions, then it's nearly impossible for someone to report it as copyright because users don't have the ability to view the url

the issue is not wether they have a contract or not. Imagine if that was the case every editor, make up artist, cinematographer, actor and anyone involved in creating content can't have a portfolio. My issue is that they have these services have automated scnabots that search for audio and maybe video clips to flag as copyright then suspend an account.

the permission to use the work in their portfolio would have to be included in their contract. it's a pretty standard clause. this won't prevent stop a copyright takedown from happening, though. But it will make it easier to fight.
Portfolio use is not protected by any copyright act

Hey everyone. I have a few friends and clients who are editors, cinematographers, directors, agencies, etc. These people work on commercials, music videos and films. I have created websites for them to display their work.
I have them all hosting their videos through Vimeo for easy management and embedding. Last week, one of my editors account was suspended for copyright infringement. He is trying to fight this, as the work in question is his editing work. He does mostly music videos but they are for extremely high profile artists (Beyonce, DJ Khaled, Britney Spears, Justin B, etc). I am afraid that my other clients are going to get suspended soon too.
My question, are there any video hosting services that are more lenient on this crap for hosting videos of ones work? Isn't there some clause in the copyright act or whatever that you can use this for portfolio pieces since its their own work?
This could apply to make-up artists, wardrobe, cinematographers, photographers, etc.
Thanks!!
