design reuse

    A large organization I created an AR for a couple years ago recently reused my design for part of their report. Last year they asked me back, but I didn't have the time for what I knew would be a time crunch = stress. They didn't hit me up this year & used a design firm.

    This is starting to be a theme, unless this is a "thing"... they reused the layout and fonts I put together for a hefty amount of content.

    I have no clause in my contract about reuse of my work. What does that clause look like for you if you've got one?

    My guess is that they scrambled for time and used what was already developed.

    Maybe I should send them a thank you and put something in my clause about permissions? Am I being a dick?

    They paid you for your first tranche of work?

    if so, you'll probably just have to suck it up.

    You should define if they're allowed to re-use your design for other work outside the original scope. And then describe the cost structure of using the work in other derivative work, you don't have to be specific but at least get them to sign on the fact that it has to be negotiated prior to them being allowed to use it for other projects.

    On the flip side, I have this paragraph regarding ownership whenever I sign a contractor:

    "The Contractor agrees that all designs, computer software or ideas of whatever kind developed in whole or in part by him/her during the term of this Agreement shall be and remain the exclusive property of the Company." etc.
