...well, someone who was actually 3 times your size (assuming you're not a small child nor a little person) would likely be a genetically mutated hybrid monster/giant. Your bullets would have no effect, therefore would not harm this man in any way. so no, you would not go to jail.
Furthermore, this aforementioned mutated hybrid monster/giant would have HAD to have learned to control his temper, or would have engaged in MANY, MANY similar altercations due to his sheer strength, and eventually been hunted by the armies of foreign governments to be recruited, or most likely, brainwashed/controlled and bread to create some further mutated supersoldier to takeover the world.
Since your original question was not "would" you go to jail, but "should" you go to jail, the answer is probably yes. Not for this, though... They were already tracking you when they learned of your plot to kidnap the president's only son.

fuck no. you run like hell. that is what i would do in this situation. nothing wrong with running when you know you are going to get beat down. and since the guy is a samoan gangster, i would run backwards with my iphone on video mode. i suddenly made this a first world problem.
