Photo Rights Question

    I have 2 photos that a local city magazine wants to use for their quarterly issue. The mag is fairly new in the market and its free to pick up their mag.

    Just curious what I should charge (or should I even charge them? Just ask for ad space). I normally sell prints at about $150-200 a piece, should I just do that and call it a day?

    Any help would be great. Cheers!

    Most publications have a page rate fee. Picture agencies charge based on that magazines circulation and how big the image is being used i.e. full bleed, quarter page etc. A title like ELLE (UK) will pay approx £80 for a quarter page image from your classic stock image library. So it all depends on how they're using it really...

    I'd try to work out a deal where you get both money and ad space. Asking for compensation sets the expectation that you won't be free in the future, and the ad space would be a nice gimme, particularly if they haven't sold out all their ad space yet. Just because the rag is free, it doesn't mean the publication isn't (hopefully) profiting.

    Be sure to get a credit line on the page the image appears. I also wouldn't go the flat rate approach in the language that would appear in your agreement (contract) with them...that terminology starts to sound like royalty-free, and I'd assume you don't want them using your images whenever/however/wherever they choose in perpetuity.

    Regardless, it comes back to your comfort level and your business...just be sure you the terms clearly stated have it in writing.

    Ps. If there title is free is irrelevant to you

    • You might be surprised at how much 'free' newspapers and magazines make..detritus
    • wouldn't be surprised at all... I know plenty of them that make huge profits based on 100% ad rev, hence my commentgoldieboy

    Im sure you can negotiate whatever you want. Its pretty much up to them, and how much you would be willing to see your work at. Ad Space may or may not bring in more revenue than 150-200, but they may not even consider that.

    Also sometimes Magazines that are small run, like free stuff. Hope you get what you want!

    Is the publication at all hitting a market that may actually buy your services in the future? Are they well enough designed that the tearsheet will look good on your website?

    Some well-paying gigs have given me unusable-in-portfolio tearsheets because of the way the designer covered my image with type and logos....

    Talk to the magazine staff, see if they're friends with other magazine people, if so, getting invited to a few parties may get you more business contacts...and try to learn about their advertisers, getting a gig shooting an ad or two in their publication may be worth more too....

    many small magazines think $150 is a lot of money.... just make sure something is exchanged, ad space or $$, not "for free"

    And make sure you keep copyright... they have limited publication rights, not all rights,etc.... if they want to use the image in a flyer, poster or subscription form, that's extra.... (or extra adspace for you)
