MONTREAL - A Westmount resident's lawsuit against Air Transat, for failure to provide him with appropriated medical attention during a flight, was dismissed in small claims court this past Tuesday.
His illness? Sudden and mysterious bleeding in the area between his legs.
The curious incident occurred February 15, 2008 during a flight from Montreal to Puerto Vallarta, Mexico. Marcel Cote was comfortably seated in business class an hour after takeoff when, for some unknown reason, he felt enough discomfort to make an emergency visit to the washroom, where he discovered spots of blood on his body.
In a panic, Cote asked for the help of a flight attendant, who quickly came to his side. When the passenger noticed that the agent was female, he asked to be assisted by a male attendant because the bleeding seemed to be coming from his genital area.
When the male attendant came to him, Cote then asked to be closely examined so that the exact nature of the problem can be determined. The employee declined, giving him absorbent paper instead.
Indignant and distressed, Cote quickly expressed his wish to see a doctor.
Before supplying him with sanitary towels, the members of the flight crew told him they would contact a physician if the illness was grave enough. On arriving in Puerto Vallarta three hours later, Mr. Cote met with a travel agent he knew and she took him to the hospital in a taxi. He was examined by a doctor who determined Cote had a ruptured vein near his scrotum. Three stitches were needed to close the wound.
What started off as a dream trip to a Southern paradise with his wife, in the end turned into a nightmare Cote said, claiming the incident ruined his vacation and has made him anxious about flying.
Cote sued Air Transat and the employees on the flight that day, accusing them of failing to provide appropriate medical assistance, seeking damages of $8,000 for the anguish he suffered as a result of their neglect.
But judge Michele Pauze rejected Cote's case.
In her decision, she said she agreed with arguments offered by Air Transat representative Chantal Chlala, who explained to the court that flight attendants do not have the right to examine passengers, and even less to make a diagnosis.
"It was not incumbent upon a flight attendant to conduct the medical examination of a passenger, a measure reserved for the medical profession,"
wrote judge Pauzé.
Although she conceded that Cote could very well have experienced troubling moments in the episode, the judge maintained that "nothing in the facts (put before us) proves that that the situation was dangerous or worrisome to the point of requiring the immediate attention of a doctor."
Not only did Pauze rule against Cote, she also ordered him to pay for the court costs incurred by Air Transat, amounting to $189.

WASHINGTON — President Obama on Monday will direct federal regulators to move swiftly to grant California and 13 other states the right to set strict automobile emissions and fuel efficiency standards, two administration officials said Sunday evening.
The directive makes good on an Obama campaign pledge and marks a sharp reversal from Bush administration policy. Granting California and the other states the right to regulate tailpipe emissions is one of the most dramatic actions Mr. Obama can take to quickly put his stamp on environmental policy.
The presidential orders will require automobile manufacturers to begin producing and selling cars and trucks that get higher mileage than the national standard, and on a faster phase-in schedule. The auto companies had lobbied hard against the regulations and challenged them in court.
Mr. Obama will use the announcement of his latest directive to bolster the impression of a sharp break from the Bush era on all fronts. It follows his decisions last week to close the detention facility at Guantánamo Bay, Cuba, tighten limits on interrogation tactics by CIA officers, order plans to withdraw combat forces from Iraq and reverse Mr. Bush’s financing restrictions on groups that provide or discuss abortion overseas.
Beyond the California waiver, officials said, Mr. Obama will announce that he is moving forward with nationwide regulations requiring the automobile industry to increase fuel efficiency standards, rules that the Bush administration decided at the last minute not to issue. He will also order federal departments and agencies to find new ways to save energy and be more environmentally friendly. And he will highlight the elements in his economic plan intended to create new jobs around renewable energy.
The announcements, likely to be made in the East Room, will kick off a week of efforts to get the economy plan through Congress. The White House hopes the Senate will confirm Timothy F. Geithner as Treasury secretary on Monday, and Mr. Obama plans to travel to Capitol Hill on Tuesday to meet with both Senate and House Republican caucuses and lobby for his stimulus package. Mr. Obama’s aides expect the House to vote on its plan on Wednesday.
In a White House announcement scheduled for Monday morning, Mr. Obama will also direct federal agencies to immediately begin work on making all government buildings more energy efficient, with an eye toward saving as much as $2 billion a year and reducing the emissions of carbon dioxide and other gases blamed for the warming of the planet.
He will also direct the Department of Transportation to immediately begin drafting automobile fuel-economy regulations to comply with a law enacted in December 2007. Former President Bush delayed implementation of the law and left office saying there was not sufficient time to write the rules.
But the centerpiece of Monday’s East Room announcement is Mr. Obama’s directive to the Environmental Protection Agency to immediately begin work on granting the so-called California waiver, which allows the state, a longtime leader in air quality matters, to set its own standards for automobile emissions. The Bush administration denied the waiver in late 2007, saying that allowing California and the 13 other states the right to set their own pollution rules would result in an unenforceable patchwork of environmental law. The automakers had advocated such a position, saying it would require them to produce two sets of vehicles, one to meet the strict California standard and another that could be sold in the remaining states.

86 Frames shot from 11:59 PM EST to 2:29 AM EST from the 15th Floor of the Oakes Hotel Overlooking the Falls. Interval between shots varied between 1min, 2min and 5min. Nikon D300, 18-200VR. This is more of an experiment for the built-in Intervalometer of the D300 and how it works in regards to time and actually learning how to use it. I tried it back in my 4th of July timelapse, but switched back to manual operation.
Things to remember:
Need good tripod (Plastic one (Targus) doesn't cut it.)
Need bigger CF Card (Just in case for shorter intervals with longer shooting time.)
OR
Tether to computer.
Hook the camera to an outlet for power so the batteries won't die midway.

This time of year, especially what has been going on with the economy is very tough on people, and this year it's all about giving to those in need, not breaking our goal or winning a free lunch. I ask that if you can, give whatever you can give, every bit counts. One dollar can buy nearly 2 kilos (4lb) of food. We are record holder for the biggest canned food drive within a two week period--372,000 lbs of food in 2005. Last year we raised over 50,000 dollars and 30,000 pounds of food--thats over 250,000 pounds. If you live in the Peninsula or even the Bay Area, the next two weeks, me as well as people from my school will be at supermarkets from Palo Alto to San Bruno, and everywhere in between collecting donations. We lost for the 5th straight year, but it was actually a close game. What I'm more pissed about is The Tool playing with the camera (the 70-200, grip and the mono were all rented), he dropped the tripod ring knob onto the field and i spent a good 20min looking for it, thank god it was before the game acutally started, good thing i found it, and then he must of done something to the grip to make it read no battery even though there are 2 fully charged ones. that meant i had to restart the camera which made me miss half my shots. so then he goes and tells me to f off and then goes tells his friends about me. two days before for our rally, his and his gf's slideshow--yeah, they used all of my pictures from past events and never bothered to thank me. at least they kinda asked before hand...

Basically the school district has to leave their cash with the county, in this case they invested it into Lehman Brothers. 2.9 Billion was in the investment pool, 155 million was lost, 5 million affecting my school district, and from that, 1.5 million affecting the education fund.

I need a name that can appeal to both my friends and classmates I photograph, and the parents who usually control the finances online, basically something that can at least be understood by the not so tech savvy in us. One big delta (downside) of the current name is that people actually try to pronounce the omg. (about 25% of people...)
